This website and online store are operated by Murder Farms, Inc., doing business as Murder Farms (“Murder Farms,” “we,” “us,” or “our”).

Throughout these Terms of Service, the terms “Site” and “Services” refer collectively to the Murder Farms website, online store, products, content, features, communications, and related services.

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer our products and Services to you.

These Terms of Service (“Terms”) govern your access to and use of the Services, including purchases made through the Site. By visiting the Site, submitting information, creating an account, placing an order, or otherwise using the Services, you agree to these Terms and to the policies incorporated into them, including our:

Privacy Policy
Return and Refund Policy
Shipping Policy
Product instructions and safety warnings
Any additional terms displayed in connection with a product, promotion, preorder, subscription, or other feature

If you do not agree to these Terms, you may not access or use the Services.

1. Eligibility

You must be at least 18 years old or the age of legal majority where you live to make a purchase through the Services.

By using the Services, you represent that:

We may update these Terms periodically to reflect changes to our products, Services, business practices, technology, or legal obligations.

The current version will be posted on this page with an updated “Last updated” date. Unless otherwise stated, updated Terms become effective when posted.

Your continued use of the Services after updated Terms are posted constitutes your acceptance of the changes to the extent permitted by law.

3. Products and Product Information

Murder Farms offers home-care, cleaning, fragrance, candle, personal-care, and related lifestyle products.

We make reasonable efforts to present product information accurately. However:

Product packaging, labels, ingredients, formulas, colors, vessels, sizes, and other details may change.
Product colors may appear differently depending on your screen or device.
Fragrance and scent perception are subjective and may differ from person to person.
Product photography may include props, styling elements, surfaces, or environmental details that are not included with the product.
Products may have natural variations in appearance, texture, fragrance, or finish.
Product availability and specifications may change without notice.

The label, packaging, directions, ingredients, and safety warnings supplied with a product control if they differ from general descriptions presented elsewhere on the Site.

We reserve the right to discontinue a product or limit its sale by customer, household, geographic region, jurisdiction, order quantity, or other reasonable criteria.

4. Product Safety and Proper Use

You are responsible for reading and following all instructions, warnings, care information, and safety information supplied with a Murder Farms product.

Cleaning and Home-Care Products

Unless a product label specifically states otherwise:

Use each product only for its intended household purpose.
Do not ingest cleaning or home-care products.
Avoid contact with eyes and other sensitive areas.
Keep products out of reach of children and pets.
Do not mix products with bleach, ammonia, acids, or other household chemicals.
Use products in appropriately ventilated areas.
Test products on a small, inconspicuous area before applying them to an entire surface.
Do not use a product on a material or surface for which it is not recommended.
Stop using a product if irritation, discoloration, damage, or another unexpected reaction occurs.

Natural stone, sealed and unsealed wood, painted surfaces, metals, fabrics, specialty finishes, and other materials may react differently to cleaning products.

Murder Farms is not responsible for damage caused by improper use, failure to test a surface, use on an unsuitable material, alteration of a product, or failure to follow product instructions.

Dish Wash

Dish Wash products should be used only as directed on the label.

Unless specifically identified as dishwasher-safe detergent, Murder Farms Dish Wash is intended for handwashing dishes and should not be placed in an automatic dishwasher.

Hand Soap and Personal-Care Products

Hand Soap and other topical products are intended for external use only.

Avoid contact with eyes. Discontinue use if irritation or an allergic reaction occurs. Customers with known sensitivities should review available ingredient information before use.

Candles

When using candles:

Never leave a burning candle unattended.
Keep candles away from children, pets, drafts, flammable materials, and heat-sensitive surfaces.
Place candles on a stable, level, heat-resistant surface.
Follow all wick-trimming, burn-time, extinguishing, and care instructions.
Do not move or handle a candle while the wax or vessel is hot.
Discontinue use if a vessel becomes cracked, damaged, or unusually hot.
Do not burn a candle below the recommended remaining wax level.

You assume responsibility for using all products safely and according to their instructions.

Nothing in these Terms limits liability that cannot legally be limited, including liability arising from a defective product where applicable law provides otherwise.

5. No Medical or Professional Advice

Statements concerning fragrance, atmosphere, ritual, mood, cleanliness, ingredients, or product experience are descriptive and are not medical claims.

Murder Farms products and content are not intended to diagnose, treat, cure, or prevent any disease, medical condition, allergy, or health issue.

Information provided through the Services is not a substitute for medical, safety, veterinary, or other professional advice.

6. Orders

Submitting an order constitutes an offer to purchase the products identified in the order.

An automated order confirmation acknowledges that we received your order. It does not necessarily mean that the order has been accepted, processed, or fulfilled.

We reserve the right to accept, reject, limit, or cancel an order for reasons including:

Product unavailability.
Suspected fraud or unauthorized activity.
Incorrect pricing or product information.
Inventory or technical errors.
Shipping or geographic restrictions.
Orders that appear to be placed for unauthorized resale.
Violation of these Terms.
Circumstances outside our reasonable control.

We may contact you for additional information before accepting or fulfilling an order.

If we cancel an order after collecting payment, we will issue an appropriate refund to the original payment method.

7. Under Cultivation, Waitlists, Backorders, and Preorders

Certain products may be described as under cultivation, coming soon, temporarily unavailable, backordered, available for preorder, or available through a waitlist.

Submitting your contact information to express interest in a product does not create a purchase or guarantee that the product will become available.

A binding purchase occurs only when:

You complete an applicable checkout process.
You receive confirmation that an order has been accepted.
Any required payment has been authorized or collected.

For preorders or backorders:

Estimated availability and shipping dates are estimates and are not guaranteed.
Availability dates may change due to production, supply, testing, packaging, fulfillment, or shipping conditions.
Products in the same order may ship separately.
We may contact you if an expected fulfillment date changes materially.
Your payment method may be charged when the order is placed or when the item ships, as disclosed during checkout.
Cancellation and refund rights are governed by the terms presented with the product, our Return and Refund Policy, and applicable law.

We reserve the right to discontinue or cancel an unavailable product. If we cannot fulfill a paid order, we will issue a refund for the unfulfilled item.

8. Pricing and Payment

All prices are displayed in U.S. dollars unless otherwise stated.

Prices, discounts, promotions, product availability, and offers may change without notice.

A price change will not affect an order that we have already accepted, except where correction is permitted for an obvious pricing, typographical, inventory, or technical error.

Applicable taxes, shipping charges, duties, and other fees may be calculated and displayed during checkout.

You agree to provide current, complete, and accurate billing and payment information. You authorize Murder Farms and its payment providers to charge the payment method you provide for:

Products purchased.
Shipping and handling.
Applicable taxes.
Duties or other charges disclosed during checkout.
Other amounts you expressly authorize.

Payments may be processed through Shopify, Shopify Payments, or other third-party payment providers. Murder Farms does not necessarily receive or store your complete payment-card information.

If a payment cannot be verified, is declined, or is reversed, we may suspend or cancel the associated order.

9. Promotions and Discount Codes

Promotions, discounts, giveaways, gift cards, and special offers may be subject to additional terms displayed with the offer.

Unless otherwise stated:

Promotions are available for a limited time.
Discount codes cannot be combined.
Discounts have no cash value.
Discounts cannot be applied retroactively.
Promotions may be limited by customer, household, order, product, or geographic location.
Gift cards cannot be redeemed for cash except where required by law.
Discounts may not apply to shipping, taxes, gift cards, preorders, bundles, or certain products.
We may cancel or modify an offer affected by error, fraud, misuse, or circumstances outside our reasonable control.

10. Shipping and Delivery

Shipping times and delivery dates displayed through the Services are estimates and are not guaranteed.

Delivery timing may be affected by:

Destination.
Carrier performance.
Weather.
Inventory.
Production schedules.
Order volume.
Customs processing.
Events outside our reasonable control.

Additional shipping terms are described in our Shipping Policy, which is incorporated into these Terms.

You are responsible for providing an accurate and deliverable shipping address.

Murder Farms is not responsible for delivery delays or failures caused by an incorrect or incomplete address, carrier interruption, customs processing, refusal of delivery, failure to retrieve a package, or circumstances outside our reasonable control.

Please contact us promptly if an order arrives damaged, broken, leaking, incomplete, or materially different from what you ordered.

11. Returns, Exchanges, and Refunds

Returns, exchanges, damaged products, cancellations, and refunds are governed by our Return and Refund Policy.

Eligibility may depend on:

The type of product.
The date it was delivered.
Whether it has been opened or used.
Its condition.
Health, hygiene, or safety considerations.
Applicable shipping restrictions.
Whether the product was final sale, personalized, or specially produced.

Nothing in these Terms limits mandatory consumer rights available under applicable law.

12. Customer Accounts

Certain features may allow you to create a customer account.

You agree to:

Provide accurate account information.
Keep your login credentials confidential.
Restrict unauthorized access to your account and devices.
Promptly notify us of suspected unauthorized activity.
Accept responsibility for activity occurring through your account to the extent permitted by law.

We may suspend or terminate an account if we reasonably believe it has been compromised, used fraudulently, or used in violation of these Terms.

13. Marketing Communications

You may choose to receive promotional email or text-message communications from Murder Farms.

Consent to receive promotional communications is not required as a condition of making a purchase.

You may unsubscribe from promotional email messages by using the unsubscribe link contained in the message. You may continue to receive non-promotional communications relating to orders, transactions, customer-service requests, account activity, or product safety.

If Murder Farms introduces an SMS marketing program, separate Mobile Messaging Terms may be presented when you enroll. Those terms will describe message frequency, carrier charges, opt-out instructions, and support information.

14. Reviews, Feedback, and Customer Content

The Services may allow you to submit reviews, photographs, comments, testimonials, feedback, suggestions, social-media content, or other materials collectively referred to as “Customer Content.”

You retain ownership of your original Customer Content.

By submitting Customer Content directly to Murder Farms or otherwise giving us permission to use it, you grant Murder Farms a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, edit, adapt, publish, display, distribute, and create derivative works from the Customer Content for purposes including:

Operating and promoting Murder Farms.
Displaying reviews and customer experiences.
Website, email, advertising, social-media, and marketing use.
Product and service improvement.

You represent that:

You own or control the rights necessary to submit the Customer Content.
The Customer Content does not violate another person’s intellectual-property, privacy, publicity, or contractual rights.
The Customer Content is not false, unlawful, threatening, defamatory, obscene, malicious, or intentionally misleading.
Any review or testimonial reflects your honest experience.

We may remove, reject, edit, or decline to publish Customer Content at our discretion, but we are not required to monitor all submissions.

15. Intellectual Property

The Services and their contents are owned by or licensed to Murder Farms and are protected by copyright, trademark, trade-dress, and other intellectual-property laws.

Protected materials may include:

The Murder Farms name and logos.
Product and scent names.
Packaging and label designs.
Photographs and videos.
Illustrations and artwork.
Product descriptions and written content.
Website design and layout.
Graphics, icons, typography, and visual systems.
Advertising concepts and campaign materials.
Software and related technology.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial shopping and informational purposes.

Except as expressly permitted, you may not copy, reproduce, modify, republish, distribute, sell, license, publicly display, scrape, download, or commercially exploit any portion of the Services without our prior written permission.

The Murder Farms name, product names, marks, designs, packaging, and trade dress may not be used without prior written consent.

16. Prohibited Uses

You may not use the Services:

For an unlawful, fraudulent, harmful, or deceptive purpose.
To violate another party’s intellectual-property, privacy, publicity, or other rights.
To transmit viruses, malware, harmful code, or disruptive technology.
To gain unauthorized access to an account, system, network, or data.
To scrape, crawl, harvest, or extract information through automated means without permission.
To impersonate another person or misrepresent your identity or affiliation.
To interfere with the security or operation of the Services.
To submit fraudulent orders, false reviews, or misleading information.
To circumvent order limits, access restrictions, or security controls.
To resell products without authorization where authorization is required.
To copy our products, packaging, content, branding, or creative materials in a manner that violates our rights.
To engage in conduct that could harm Murder Farms, Shopify, our customers, or other users.

We may suspend or terminate access to the Services for prohibited conduct.

17. Third-Party Services and Links

The Services may contain links to or integrations with third-party websites, applications, payment providers, shipping carriers, social-media services, or other platforms.

Third-party services are controlled by their respective operators and are subject to their own terms and privacy policies.

Murder Farms does not control and is not responsible for the content, security, availability, accuracy, or practices of third-party services.

Your use of a third-party service is at your discretion and subject to the third party’s terms.

18. Shopify

Our online store is hosted by Shopify.

Shopify provides the ecommerce infrastructure that supports the Site and may process information and transactions necessary to provide its services.

The contract for the purchase and sale of Murder Farms products is between you and Murder Farms, not between you and Shopify.

Shopify is not responsible for:

The products sold by Murder Farms.
Product descriptions or safety claims.
Order fulfillment.
Customer service.
Returns or refunds.
Product quality.
Disputes between Murder Farms and its customers.

19. Privacy

Our collection, use, and disclosure of personal information are described in our Privacy Policy.

By using the Services, you acknowledge that information may be processed by Murder Farms, Shopify, payment providers, shipping carriers, analytics providers, marketing providers, and other service providers as described in that policy.

20. Errors, Inaccuracies, and Omissions

Information on the Site may occasionally contain typographical errors, inaccuracies, or omissions relating to:

Product descriptions.
Ingredients.
Pricing.
Promotions.
Shipping charges.
Delivery estimates.
Product availability.
Images or specifications.

We reserve the right to correct errors, update information, and cancel orders affected by inaccurate information, including after an order has been submitted.

If we cancel a paid order because of an error, we will issue an appropriate refund.

21. Service Availability and Changes

We may modify, suspend, restrict, or discontinue any portion of the Services or product offering at any time.

We do not guarantee that:

The Services will always be available.
Access will be uninterrupted or error-free.
All technical issues will be corrected immediately.
All products will remain available.
All Site information will always be complete or current.

We may perform maintenance or introduce, modify, or remove features without advance notice where reasonable.

22. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

MURDER FARMS DISCLAIMS WARRANTIES NOT EXPRESSLY PROVIDED IN WRITING, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT:

THE SERVICES WILL MEET EVERY REQUIREMENT.
ACCESS WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
WEBSITE CONTENT WILL ALWAYS BE ACCURATE OR COMPLETE.
EVERY PRODUCT WILL PRODUCE THE SAME RESULT ON EVERY SURFACE.
EVERY CUSTOMER WILL EXPERIENCE A FRAGRANCE IN THE SAME WAY.
PRODUCT APPEARANCE WILL EXACTLY MATCH ITS DISPLAY ON A PARTICULAR DEVICE.

Products may be covered by warranties or consumer rights that cannot be disclaimed under applicable law. Nothing in these Terms excludes those rights.

23. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MURDER FARMS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATING TO:

YOUR USE OF OR INABILITY TO USE THE SERVICES.
WEBSITE INTERRUPTION OR TECHNICAL ERROR.
UNAUTHORIZED ACCESS TO INFORMATION.
RELIANCE ON WEBSITE CONTENT.
THIRD-PARTY SERVICES.
IMPROPER OR UNAUTHORIZED PRODUCT USE.
FAILURE TO FOLLOW PRODUCT INSTRUCTIONS OR WARNINGS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICES, THESE TERMS, OR A PRODUCT WILL NOT EXCEED THE GREATER OF:

THE AMOUNT YOU PAID FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM; OR
ONE HUNDRED U.S. DOLLARS ($100).

These limitations do not apply to liability that cannot lawfully be excluded or limited, including liability for fraud, willful misconduct, gross negligence, personal injury caused by negligence, defective products, or violation of mandatory consumer rights.

Some jurisdictions do not permit certain warranty disclaimers or liability limitations. In those jurisdictions, these provisions apply only to the maximum extent permitted by law.

24. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Murder Farms and its owners, officers, employees, contractors, affiliates, agents, licensors, and service providers from third-party claims, liabilities, losses, damages, judgments, costs, and reasonable attorneys’ fees arising from:

Your unlawful use of the Services.
Your material violation of these Terms.
Your intentional misuse of a product.
Your violation of another person’s rights.
Customer Content you submit.
Fraudulent or unauthorized activity conducted through your account.

This section does not require you to indemnify Murder Farms for our own negligence, unlawful conduct, defective products, or liability that cannot legally be transferred.

25. Force Majeure

Murder Farms is not responsible for a delay or failure caused by circumstances beyond our reasonable control, including:

Natural disasters or severe weather.
Fire.
Labor disputes.
Transportation or carrier disruptions.
Supply-chain interruptions.
Utility, internet, or technology failures.
Government actions or restrictions.
Public-health emergencies.
War, terrorism, or civil unrest.
Failure of suppliers or service providers.

This provision does not affect refund, cancellation, or other rights that cannot lawfully be limited.

26. Suspension and Termination

We may suspend or terminate your access to the Services if:

You violate these Terms.
We reasonably suspect fraud, misuse, or unauthorized activity.
Your conduct threatens the security or operation of the Services.
Suspension or termination is required by law.
We discontinue the applicable Service.

Upon termination, the rights granted to you under these Terms end immediately.

Provisions that should reasonably survive termination will remain effective, including those concerning intellectual property, disclaimers, liability, indemnification, dispute resolution, and governing law.

27. Informal Dispute Resolution

Before filing a formal legal claim, you and Murder Farms agree to make a reasonable, good-faith effort to resolve the dispute informally.

A dispute notice should include:

Your name and contact information.
The relevant order number, when applicable.
A description of the issue.
The resolution you are requesting.

Nothing in this section prevents either party from seeking emergency relief, filing an eligible claim in small claims court, reporting a concern to a government agency, or exercising a right that cannot legally be restricted.

28. Governing Law and Venue

These Terms and disputes arising from them are governed by the laws of the State of California, without regard to conflict-of-law principles.

This provision does not deprive you of mandatory consumer protections available under the laws of the jurisdiction where you live.

Any court proceeding permitted under these Terms will be brought in an appropriate state or federal court located in San Diego County, California, unless applicable law permits or requires a different location.

You and Murder Farms consent to the jurisdiction of those courts to the extent permitted by law.

29. Electronic Communications

By using the Services, you consent to receive agreements, notices, disclosures, receipts, order information, and other communications electronically.

Electronic communications may be delivered through:

Email.
The Site.
Your customer account.
Checkout or order-status pages.
Text message, where you have consented.

Electronic communications satisfy legal requirements that communications be in writing to the extent permitted by law.

30. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

Murder Farms may assign or transfer these Terms in connection with a merger, acquisition, financing, corporate reorganization, sale of assets, or similar business transaction.

31. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, it will be enforced to the maximum extent permitted or modified as necessary to make it enforceable.

The remaining provisions will continue in full force.

32. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision later.

A waiver is effective only if it is in writing and authorized by Murder Farms.

33. Entire Agreement

These Terms, together with the policies and additional terms incorporated by reference, constitute the entire agreement between you and Murder Farms concerning the Services.

They replace prior or contemporaneous communications relating to the same subject matter.

Section headings are provided for convenience and do not affect interpretation.
